Restarting EB-5 Investments After Big Behring Legal Victory

In challenging USCIS’s unilateral cancellation of the EB-5 Regional Centers in April, the BRC asserted that USCIS’s actions were contrary to the plain meaning of the RIA. BRC further claimed that USCIS’s creation of new Forms I-956 and redesignation requirements violated the Administrative Procedure Act because USCIS had not adopted notice and comment rules. In granting BRC’s preliminary injunction, the court said “Behring made an extremely strong showing that the agency violated the APA. USCIS was almost certainly wrong in assuming that the Integrity Act has effectively banned existing regional centers, so the agency was almost certainly wrong to announce that centers are no longer licensed.” He agreed that BRC was likely to succeed on the merits of his case and that USCIS was wrong to assume that the RIA had revoked the authorization of existing regional centers. In recent weeks, Congress had also signaled its support by sending letters advising USCIS that its actions ran counter to Congress’s intention to restart the EB-5 Regional Center program as soon as possible after a period of 9 months.
